Terms of Service
These terms govern use of TRUZT services, vehicle transactions, financing workflows, payment obligations, collections actions, and after-sales support.
Introduction
These Terms of Service govern your use of TRUZT websites, digital applications, support channels, vehicle sales flows, finance applications, leasing workflows, payment services, and related communications. By using the service, you agree to these terms and any specific order, finance, refund, warranty, or partner terms that apply to your transaction.
Acceptance of Terms
- By accessing or using TRUZT websites, applications, communications, and vehicle commerce services, you agree to these Terms of Service.
- If you do not agree, you must not use the service or submit orders, applications, or payments through the platform.
- We may update these terms from time to time. Continued use after updates take effect means you accept the revised terms.
- Specific products, promotions, finance offers, service packages, or partner programs may carry additional written terms.
Vehicle Sales, Orders, and Delivery
- Vehicle prices, availability, specifications, lead times, and included accessories may change before order confirmation.
- Estimated delivery timelines are operational estimates, not guarantees, and may change due to sourcing, customs, shipping, regulatory, supplier, or force majeure events.
- Vehicle photos, descriptions, and pricing tools are provided for guidance; final order details are confirmed in your order summary and supporting documents.
- TRUZT may refuse, pause, or cancel an order where pricing errors, fraud concerns, stock issues, compliance failures, or contractual disputes arise.
Payments, Financing, and Repayment Schedules
- Payments must be made using approved methods and in accordance with the order, invoice, finance, or lease arrangement applicable to your transaction.
- Finance, lease, and installment approvals are conditional until all verification, underwriting, partner, and documentation requirements are satisfied.
- Repayment schedules, installment amounts, due dates, and approved schedule changes are binding once confirmed in your order or finance records.
- Partial payments may be applied to the oldest overdue amount first before being applied to newer dues, fees, or penalties.
- Refunds, reversals, and cancellations are governed by the applicable order documents and refund policy.
Late Payment and Collections
- If an installment is not paid by its due date, the account may enter overdue status and TRUZT may send reminder notices by email, SMS, in-app message, or direct staff outreach.
- A grace period applies for the first three days after the due date unless your written agreement states otherwise.
- On Day 4 overdue, a one-time late fee of 5% of the overdue installment may be applied.
- From Day 5 overdue onward, an additional daily penalty of GHS 50 may accrue until the overdue amount is cured or the penalty cap is reached.
- Total penalties on a single overdue installment are capped at the lower of 25% of the original installment amount or GHS 2,500.
- Where permitted by your contract and applicable law, overdue or default status may also lead to collections escalation, suspension of non-essential privileges, denial of new concessions, restructuring review, or enforcement action.
Warranties, Maintenance, and Service
- Warranty coverage is limited to the scope, duration, and exclusions stated in the applicable vehicle, add-on, service, or manufacturer documents.
- Maintenance scheduling, service-center capacity, warranty processing, and third-party service timelines may vary.
- Damage caused by misuse, accident, unauthorized modification, neglect, or use outside approved conditions may void or reduce available coverage.
Your Responsibilities
You are responsible for using the platform honestly, lawfully, and in line with your contractual obligations.
Limitations of Liability
To the maximum extent permitted by law, TRUZT will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the platform, vehicle orders, payment flows, service delays, or related transactions.
- TRUZT is not liable for indirect, incidental, consequential, special, or punitive damages to the extent permitted by law.
- TRUZT is not responsible for supplier, manufacturer, customs, logistics, payment-network, or government delays outside its reasonable control.
- Our aggregate liability is limited to the amount you paid to TRUZT for the specific product or service giving rise to the claim, except where law prohibits that limitation.
- Nothing in these terms excludes liability that cannot lawfully be excluded.
Governing Law and Disputes
These terms are governed by the laws of Ghana. Before escalating a dispute, you agree to contact TRUZT in good faith so the issue can be reviewed through customer support, finance, or the relevant operational team.
If a matter cannot be resolved internally, the parties may pursue the remedies available under applicable law and the relevant transaction documents.
